Terms of Service

By downloading, installing, or using the AI Scan application ("App") developed by SamalaiTech ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and SamalaiTech regarding your use of the App.

AI Scan is a mobile application that provides document scanning, optical character recognition (OCR), PDF creation and export, and document management features. The App is available in both free and premium subscription tiers.

You must be at least 13 years of age to use the App. If you are under 18, you must have the consent of a parent or legal guardian. By using the App, you represent and warrant that you meet these eligibility requirements.

Some features of the App may require you to create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials.
• All activities that occur under your account.
• Notifying us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms.

a. Free Tier

The free version of AI Scan provides basic scanning and export features with advertisements. Feature availability in the free tier may change at our discretion.

b. Premium Subscription

• Premium features are available through in-app subscription purchased via Apple App Store or Google Play Store.
• Subscription fees are charged to your app store account upon confirmation of purchase.
• Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period.
• You can manage or cancel your subscription through your device's app store settings.

c. Refunds

Refund requests are handled by Apple App Store or Google Play Store in accordance with their respective refund policies. We do not process refunds directly.

You agree not to use the App to:

• Violate any applicable laws, regulations, or third-party rights.
• Scan, copy, or distribute copyrighted materials without authorization.
• Upload, transmit, or distribute any malicious code, viruses, or harmful software.
• Attempt to reverse-engineer, decompile, or disassemble the App.
• Use the App for any fraudulent, deceptive, or illegal activity.
• Interfere with or disrupt the integrity or performance of the App.
• Scrape, mine, or collect data from the App through automated means.

The App, including its design, features, code, graphics, trademarks, and all related intellectual property, is owned by SamalaiTech and is protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms. This license does not include the right to:

• Modify, copy, or create derivative works of the App.
• Sublicense, sell, or distribute the App.
• Use any trademarks, logos, or branding of SamalaiTech without written permission.

You retain ownership of all documents, images, and files you create or scan using the App ("User Content"). By using the App, you grant us no rights to your User Content. We do not access, view, or store your User Content on our servers unless you explicitly use a cloud-based feature.

You are solely responsible for the legality and appropriateness of your User Content.

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy to understand our data practices.

The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to:

• Implied warranties of merchantability and fitness for a particular purpose.
• Accuracy, reliability, or completeness of OCR results.
• Uninterrupted or error-free operation of the App.
• Compatibility with all devices or operating systems.

OCR and AI features provide approximate results. You should always verify the accuracy of scanned text for critical or legal documents.

To the maximum extent permitted by applicable law, SamalaiTech and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of data, documents, or files.
• Loss of profits, revenue, or business opportunities.
• Inaccurate OCR or text recognition results.
• Unauthorized access to your device or data.

Our total liability for any claim arising from the use of the App shall not exceed the amount you paid for the App or subscription in the twelve (12) months preceding the claim.

You agree to indemnify and hold harmless SamalaiTech, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or related to your use of the App or your violation of these Terms.

We may suspend or terminate your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.

Upon termination, your right to use the App ceases immediately. Provisions of these Terms that by their nature should survive termination shall continue to apply.

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms within the App and updating the "Effective Date." Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in India.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.

These Terms, together with the Privacy Policy, constitute the entire agreement between you and SamalaiTech regarding your use of the App and supersede all prior agreements and understandings.
